Terms of Service

You must be at least 13 years old — or the minimum age required to use Twitch in your country — and you must be of legal age of majority in your jurisdiction or have the consent of a parent or legal guardian. You must comply with the Twitch Terms of Service and Community Guidelines. The Service is void where prohibited by law. We may require verification of eligibility at any time.

MikuBrawl is an independent fan project. It is not affiliated with, endorsed, sponsored by, or associated with Twitch, Brawlhalla, Blue Mammoth Games, Ubisoft, StreamElements, Valve Corporation / Steam, or any gift-card issuer or other brand. All product names, logos, and trademarks are the property of their respective owners and are used for identification only.

The Service lets you accumulate non-monetary “points” for watching the associated stream and engaging with features such as a daily wheel, seasonal leaderboards, and giveaways, and to exchange points for rewards while supplies last. The Service is provided free of charge. We may add, change, suspend, limit, or discontinue any part of the Service — including points, rewards, ranks, seasons, giveaways, or the entire Service — at any time, for any reason, without notice or liability.

Points are a virtual, promotional in-app score. They are not money, not currency, not credit, and have no cash or monetary value. You do not own points; they are a revocable license to use a feature of the Service. Points are personal to you, are not property, and may not be sold, transferred, traded, gifted, exchanged for cash, or combined across accounts.

We may adjust, expire, reset, withhold, or remove points and ranks at any time at our sole discretion — including to correct errors, address abuse, or end a season — without notice or liability. We are not responsible for any loss of points for any reason.

Rewards (including gift-card codes and other items) are offered subject to availability and may be changed, limited, or withdrawn at any time. Rewards are provided “as is” and “as available” with no warranty of any kind. Once a code or reward is issued it is final and non-refundable, non-returnable, and non-exchangeable.

We are not the issuer of third-party gift cards and are not responsible for their activation, value, validity, regional restrictions, expiration, or use, nor for any acts or policies of the issuer. Any reward delivered in error, obtained through a bug, or obtained in violation of these Terms is void and may be revoked.

Giveaways are optional promotional activities. No purchase is necessary— points are earned free by watching the stream. Giveaways are void where prohibited and are open only to eligible participants (see Eligibility). Entry requires spending points, which have no monetary value.

Winners are selected by a random draw weighted by tickets, and all selections are final. We may modify, pause, shorten, extend, void, or cancel any giveaway at any time, including in the event of suspected fraud, technical error, or abuse. Odds depend on the number of entries. Where a giveaway awards a prize of value, the winner is solely responsible for any applicable taxes and for providing any information required to deliver the prize. We are not liable for prizes that cannot be delivered, are lost, or are unclaimed.

You agree not to:

• use bots, scripts, automation, emulators, VPNs, or any method to inflate watch time, points, spins, or entries;
• create or use more than one account, or use another person’s account;
• exploit bugs, glitches, or unintended behavior, or attempt to manipulate the points or rewards systems;
• access the Service’s APIs or data in an unauthorized or automated way, or attempt to disrupt or reverse-engineer it;
• engage in fraud, abuse, harassment, or any unlawful activity.

Violations may result in immediate forfeiture of points and rewards and termination of access, at our sole discretion.

We may suspend or terminate your access and delete your account, points, ranks, and pending rewards at any time, with or without notice or cause, at our sole discretion — including for any suspected violation of these Terms. Upon termination your right to use the Service ends immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

THE SERVICE, POINTS, AND REWARDS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT POINTS, REWARDS, OR DATA WILL BE ACCURATE OR PRESERVED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF POINTS, REWARDS, DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, THE OPERATOR’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED USD $25.00. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless the operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

We may update these Terms at any time. Changes are effective when posted with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws applicable at the operator’s principal place of residence, without regard to conflict-of-law rules, and any dispute will be subject to the exclusive jurisdiction of the competent courts there. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
